Did you know that a conviction or plea to any Domestic Violence-related offense will result in you being banned from owning or possessing firearms under Federal Firearms legislation? Also, by “working out a deal” with the prosecutor to avoid jail time or substantial fines—whether the offense was excessive telephone calls, verbal sparring, or whatever—you could set yourself up for even bigger problems, like a probation violation caused by a traffic stop resulting in six months or more in the County Jail. And deferred prosecution or diversion of a case when you are not guilty could result in you being found guilty regardless of the merits of your case in the event that a minor oversight on your part results in a violation of the deferred prosecution or diversion agreement.Another factor to consider: Does the initial reporting party acknowledge that it was nothing more than a disagreement, or otherwise not want to proceed. If your case is charged in a municipal court, most prosecutors will not proceed if the alleged victim decides not to press charges, but will often not work out alternative solutions when you do not have representation.Before you do anything, call an attorney with experience in such matters.
